What is a Small Estate Affidavit in Texas?
A Texas Small Estate Affidavit can be used when total estate assets (excluding the homestead and exempt property) are $75,000 or less, the deceased passed without a will, and no unpaid debts exist beyond what is secured by the homestead. It is filed with the court but requires no full administration. Typical process: 4–6 weeks.
What is Muniment of Title?
A streamlined Texas probate procedure when the deceased left a valid will, there are no unpaid unsecured debts, and no estate administration is needed. The court admits the will as a muniment of title , proof of transfer , without appointing an executor. Faster and less expensive than full probate.
What if there is no will?
The estate passes under Texas intestacy law. An Affidavit of Heirship , signed by two disinterested witnesses , can often establish title without a court proceeding. We assess this on a case-by-case basis with our title company.
